§ 9-137. Commercial waste collection.

  • All commercial, institutional, governmental, charitable and religious establishments shall be required to utilize solid waste collections services.

    Every establishment, as identified in this section, located within the city shall contract with the city, or with a licensed hauler, for solid waste service. If the establishment declines the city's commercial solid waste service, the establishment shall provide the public works director with proof of a contract with a licensed hauler.

    Alternatively, if the establishment elects to haul and dispose of its own solid waste, the establishment shall be required to provide written notification to the public works director of the establishment's intent to haul its own waste to permitted disposal facilities.

    Every establishment, as identified in this section, located within the city shall provide, or be provided with, solid waste receptacle(s) with sufficient quantity to accommodate the solid waste generated by the establishment during the interval between collections as determined by the public works director.

    Containers provided by establishments shall be compatible with the city's collection system.

    Alternatively, bulk containers may be rented from the city. Six (6) cubic yard bulk containers shall be rented by establishments, as identified in this section, at a rate of twenty-three dollars ($23.00) per month. Eight (8) cubic yard containers shall be rented at a rate of twenty-five dollars ($25.00) per month.

    If, in the opinion of the public works director, the city's standard bulk containers do not effectively or efficiently meet the solid waste disposal needs of an establishment, as identified in this section, the city may provide the establishment with a roll-off commercial container. Roll-off containers shall be rented by establishments, as identified in this section, at a rate of fifty dollars ($50.00) per month per container. Establishments shall also be charged a twenty-five dollar ($25.00) fee each time the container is emptied by the city.

    Within the central business district (CBD), the city shall provide common bulk containers to meet the solid waste disposal needs of businesses located in the district. The public works director shall determine the number, size and location of common bulk containers and shall determine the collection frequency based upon demand in the CBD.

    Businesses within the CBD may request a mobile cart(s) provided the cart(s) is stored in a location that is not visible from a public street. Mobile carts in the CBD shall be subject to the terms and conditions of residential solid waste service. Commercial establishments using mobile carts shall be charged a monthly solid waste fee of ten dollars ($10.00). Additional mobile carts shall be billed at a monthly rate of thirteen dollars ($13.00) per cart. The fee for additional mobile carts shall be in addition to the monthly mobile cart fee. Failure to pay the applicable solid waste fees may result in termination of utilities and solid waste services by the city.

    All establishments, as identified in this section, contracting with the city for bulk container solid waste services shall be allowed a weekly collection volume of six (6) cubic yards without charge, which is equivalent in volume to the volume of a six (6) cubic yard bulk container. Collection in quantities greater than six (6) cubic yards per week shall be billed at a rate of three dollars and fifty cents ($3.50) per cubic yard.

    Bulk containers shall be kept in a place easily accessible to city equipment at all times. Service to establishments may be withheld, suspended or terminated for permitting objects, obstructions or vehicles to hinder in any way the servicing of the bulk containers.

    Establishments, as identified in this section, that contract with the city for bulk container service are purchasing bulk container service only and therefore will not receive yard refuse and other trash loader collection services.

    Disposal of solid waste not permitted in city-provided bulk containers shall be the responsibility of the owner or may be accomplished through special pick-up by the city. Special pick-ups shall be provided at the discretion of the public works director. When approved, such pick-ups shall be arranged with the public works department prior to the garbage and/or refuse being placed outside the establishment and is subject to the special pick-up fee schedule as follows:

    Failure to comply with the provisions for special pick-up in this section shall result in mandatory removal of the material by the city. Charges shall be billed at the rate set forth in the code enforcement fee schedule in this section. The city reserves the right to add this charge to the property owner's monthly utility bill. Failure to pay these charges may result in termination of municipal utility services, or other appropriate collection methods including legal action.

    Establishments, as identified in this section, that damage rented bulk containers must compensate the city for the repair or replacement of the containers. The repair cost billed the establishment shall equal the total cost to the city for the repair work, which shall be calculated based on the labor and materials consumed during the process. The billing for replacement containers shall equal the actual cost of the replacement container to the city. The public works director shall determine the necessity of repairing or replacing the containers.

    Containers rented from the city which are damaged as a result of being emptied by city personnel shall be repaired or replaced at the expense of the city. When the useful life of the container has in the determination of the public works director been reached, the container shall be replaced at the expense of the city.

    Failure to repair or replace bulk containers owned by establishments, as identified in this section, may result in termination of solid waste collection services.

    Solid waste collection services shall be suspended for any establishment for which a container is missing or is damaged or is obstructed to such an extent as to interfere with normal collection methods.

    Failure to comply with any provision of this section or failure to pay any fee established in this section may result in the termination of utilities and solid waste collection services by the city.
