§ 9-134. Residential household garbage collection.

  • Residential garbage and refuse shall be placed in receptacles as specified in this article.

    One mobile cart shall be issued to each single-family residence in the city. Additional mobile carts may be issued to residences when it is determined by the public works director that the provision of additional mobile carts is necessary.

    A monthly garbage and trash collection service fee of ten dollars ($10.00) shall be charged and included in the monthly utility bill of the residence. Additional mobile carts shall be billed at a monthly rate of thirteen dollars ($13.00) per cart. The fee for additional mobile carts shall be in addition to the monthly garbage and trash collection service fee billed the residence. Failure to pay the prescribed garbage and trash collection service fee may result in termination of utilities and solid waste service by the city.

    Mobile carts shall remain the property of the city for use of the residence to which it is issued. Residents who damage mobile carts issued to them must compensate the city for the repair or replacement of the carts. The repair cost billed to the resident shall equal the total cost to the city for the repair work, which shall be calculated based on the labor and materials used in the repair. The billing for replacement carts shall equal the actual cost of the replacement cart to the city. The public works director shall determine the necessity of repairing or replacing the damaged cart.

    Solid waste collection services shall be suspended for any residence for which a cart is missing or is damaged to such an extent as to interfere with the city's normal method of collection. Carts that are damaged as a result of being emptied by city personnel shall be repaired or replaced at the expense of the city. When the useful life of a mobile cart has in the determination of the public work director been reached, the cart shall be replaced at the expense of the city.

    Mobile carts are to be placed at curbside by 7:00 a.m. on the day of collection and removed by 9:00 p.m. on the day of collection. Mobile carts shall be returned to, and stored in, the side or rear yard of the residence—unless unusual circumstances or conditions warrant an exception may be granted by the city and an appropriate front yard location can be identified.

    Rear yard pick up may be granted by the city when the public works director determines that a legitimate handicap exists and there is no person residing in the home that is physically capable of rolling the cart to and from the curb. The city requires a physician's statement of handicap or physical limitation.

    Household garbage should be placed in plastic garbage bags and then placed in mobile carts provided by the city. Other material in small quantities resulting from normal household use may be placed in mobile carts. However, the total weight of the filled receptacle shall not exceed two hundred (200) pounds.
